CROSS-LEASE TO FEE-SIMPLE CONVERSIONS
A cross-lease form of tenure is where two or more landowners own an undivided share of land. It will usually have buildings on it, and the land and buildings are leased between the owners. Changing to fee-simple tenure is a subdivision process that replaces your cross-lease and shared title with your own independent title, far preferred by banks, purchasers and vendors alike.
UPDATE YOUR FLATS PLAN
If the existing building outlines on your section don't match what's shown on your latest flats plan, then you'll likely have what is termed as a “defective title”. Banks often won't lend money on a defective title, which will make it more difficult to buy or sell your home. Updating your flats plan is the minimum requirement to correct a defective title.
SUBDIVIDE YOUR MINOR UNITS
In the past, minor units have been a method for landowners to add an additional residential dwelling to their property, usually for a family member or as an additional income stream. Historically these were not subdivisible due to the criteria relating to minimum area requirements in the previous District and City Plans. Under the current Unitary Plan, it is now possible, in most instances, to subdivide these and create an additional fee-simple title. Although this is not a straightforward exercise, we've done a few now, and have it down to a pretty fine art.
